By accessing or using the Genera platform and its services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms apply to all users of the Service, including users who are also contributors of content, information, and other materials or services on the platform.

Genera is an AI-native platform that provides workflow orchestration, project tracking, content management, audience engagement, integrations, analytics, and automated deployment services.

The Service includes the following products:

• Plan — AI-powered workflow and project planning
• Track — Real-time execution monitoring and risk detection
• Content — Headless CMS and digital asset management
• People — Audience segmentation and personalisation
• Connections — Third-party integrations and routing
• Insights — Analytics dashboards and predictive intelligence
• Dev — AI-assisted code generation and deployment

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice.

To access most features of the Service, you must create an account. You agree to provide accurate, complete, and current information and to update it as necessary.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at security@genera.sh of any unauthorised use.

You may not create an account using a false identity or use another person's account without permission. Accounts are non-transferable without prior written consent from Genera.

You agree not to use the Service to:

• Violate any applicable law or regulation
• Infringe on the intellectual property rights of others
• Transmit harmful, offensive, or unlawful content
• Attempt to gain unauthorised access to any part of the Service
• Interfere with the proper functioning of the Service or its infrastructure
• Use the Service to send unsolicited communications (spam)
• Reverse engineer or attempt to extract source code from the Service

We reserve the right to investigate and take appropriate action against any violation of these policies, including removing content and terminating accounts.

The Service and its original content, features, and functionality are and will remain the exclusive property of Genera Technologies and its licensors. Our trademarks may not be used in connection with any product or service without prior written consent.

Your content: You retain ownership of all content you submit to the Service. By submitting content, you grant Genera a worldwide, non-exclusive, royalty-free licence to use, process, and display that content solely for the purpose of providing and improving the Service.

You represent that you own or have the necessary rights to the content you submit and that it does not infringe on any third-party rights.

Some parts of the Service are available on a paid subscription basis. By selecting a paid plan, you agree to pay all applicable fees as described on our pricing page.

All fees are exclusive of taxes. You are responsible for paying any applicable taxes in your jurisdiction. Subscription fees are billed in advance on a monthly or annual basis and are non-refundable except as required by law.

We reserve the right to change pricing at any time. We will provide at least 30 days' notice before any price change takes effect for existing subscribers.

You may terminate your account at any time from your account settings. Upon termination, your right to use the Service ceases immediately.

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we determine violates these Terms or is harmful to other users, us, third parties, or the public interest.

Upon termination, we will retain your data for 30 days to allow for export, after which it may be permanently deleted. We will not be liable for any loss of data resulting from account termination.

To the maximum extent permitted by applicable law, Genera Technologies shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Genera Technologies is incorporated, without regard to its conflict of law provisions.

Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of that jurisdiction. You waive any objection to the laying of venue in such courts.
